PROPOSED RELINQUISHMENT OF ARTESIA BLVD. (SR-91)
FROM PACIFIC COAST HIGHWAY (SR-1) TO HARPER AVE.

 

Recommendation :

It is recommended that the City Council:

  1. Adopt the attached Resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH APPROVING COOPERATIVE AGREEMENT NO. 4317 WITH THE STATE OF CALIFORNIA PROVIDING FOR THE STATE’S RELINQUISHMENT OF ROUTE 91 (ARTESIA BOULEVARD) BETWEEN PACIFIC COAST HIGHWAY AND HARPER AVENUE" ;
  2. Approve estimated revenue from the State in the amount of $491,120. Funds will be deposited to a new fund tilted Artesia Boulevard Relinquishment; and
  3. Adopt a budget for CIP 01-174 Artesia Boulevard Rehabilitation in the amount of $491,120 (per Exhibit "B").

 

Background :

On June 22, 1999, the City Council adopted Resolution No. 99-6004 declaring its interest to accept jurisdiction of Artesia Boulevard (SR-91) from Pacific Coast Highway to Harper Avenue from the State. This was done with the understanding that the State is willing to pay the cost to place the street in good repair.

As City Council is aware, taking over the jurisdiction of Artesia Boulevard is beneficial for the following reasons:

  • It gives the City complete control over development along the street.
  • Future improvements do not have to comply with Caltrans standards but can satisfy City Standards.
  • It no longer becomes necessary for the City to obtain a Caltrans permit to construct improvements along the street.

The State has submitted Cooperative Agreement No. 4317 for Council’s approval and execution. The City Attorney has reviewed the agreement and has drafted the attached Resolution for Council’s adoption.

 

Analysis :

The State Highway relinquishment process is a time consuming, labor intensive and complex task at best. Since the Cities of Hermosa Beach, Lawndale, Manhattan Beach and Redondo Beach have similar interest, Staff of these cities teamed together with Redondo Beach taking the lead to negotiate the terms of the relinquishment. The City of Redondo Beach engaged the services of civil engineering firm to assist with investigating the estimated cost for the total rehabilitation of Artesia Boulevard within the Cities, as well as obtaining a general agreement between the State and the cities. The fee for these services is $174,000.

An agreement has been reached by all parties that the cost to place Artesia Blvd. within the cities (1,313,570-sq. ft.) in good repair is $7,016,000. Based on a percentage of the surface area of Artesia Blvd. within the City (95,637-sq. ft.) Hermosa Beach has been allocated $491,120 (please refer to the attached Exhibit "B" of Cooperative Agreement No. 4317). Following the same logic to calculate each city’s shared cost of the engineering services; Hermosa Beach’s portion of the $174,000 cost is $12,180.

 

Fiscal Impact :

Funds received from the State for relinquishment of Artesia Boulevard will be deposited to the new fund and budgeted for rehabilitation of Artesia Boulevard.

 

 

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH APPROVING COOPERATIVE AGREEMENT NO. 4317 WITH THE STATE OF CALIFORNIA PROVIDING FOR THE STATE’S RELINQUISHMENT OF ROUTE 91 (ARTESIA BOULEVARD) BETWEEN PACIFIC COAST HIGHWAY AND HARPER AVENUE

The City Council of the City of Hermosa Beach does resolve and order as follows:

Section 1 . Findings .

A. The State of California, acting through its Department of Transportation, and the City have negotiated a transfer of the ownership of that portion of Route 91 (Artesia Boulevard) between Pacific Coast Highway and Harper Avenue ("the relinquished highway"), located within the territorial boundaries of Hermosa Beach, pursuant to the authority contained in California Streets and Highways Code Section 73.

B. After the effective date of relinquishment by the State, the City will assume ownership of and responsibility for the relinquished highway.

C. The State will pay to Hermosa Beach the sum of $491,120 in fulfillment of its responsibility to place the relinquished highway in a state of good repair.

Section 2. The City Council hereby approves Cooperative Agreement No. 4317 between the State of California and the City of Hermosa Beach and authorizes the Mayor to execute same.
