CIP 97-183 LOMA UUD PROJECT - REQUEST TO DISPENSE WITH THE 
FORMAL BIDDING PROCESS FOR ON-CALL SERVICES FOR PRIVATE PROPERTY 
DUE TO NON-COMPLIANCE

 

Recommendation:

It is recommended that the City Council dispense with the formal bidding process associated with Section 13.08.110 -- Responsibility of property owners to provide service connection – Effect of noncompliance, sub-section F of the Hermosa Beach Municipal Code.

 

Background:

Currently, two property owners in the Loma District have not done any work to comply with Subsection A, Section 13.08.110 Responsibility of property owners to provide service connection – Effect of noncompliance of Chapter 13.08 Utility Undergrounding Districts of the Hermosa Beach Municipal Code. Furthermore, fifteen property owners have done some work but the work has some major deficiencies (please see Attachment A). Consequently, these conditions have the potential to delay the removal of the overhead wires and power poles.

In accordance with the provisions of Subsection E of Section 13.08.110, the City Engineer is ready to serve these properties Notices of Noncompliance with regard to the specific work required to be done. The Notice will also state that if the work is not complete within thirty (30) days after receipt of the Notice, the city engineer will cause the work to be done with cost and expense assessed against the property and may become a lien upon the property.

 

Analysis:

As Council is aware, Southern California Edison has ordered the materials necessary to start work, beginning with the installation of primary cables, in the Loma District. They plan to begin work in June. If the above mentioned private property work is not completed by July 31, 2001, removal of the overhead wires and power poles may not occur until some time in December. Because, as you know, this work cannot take place until all the private properties are converted.

The two non-compliant homeowners have each been sent three notices to comply with the City ordinances regarding utility undergrounding. In addition, several "please call the City immediately" notices were taped to their mailboxes and were ignored. Staff was able to contact one of these property owners by phone and was told that he would rather sell his home than initiate the work. City Staff and Edison inspectors have exhausted themselves encouraging the fifteen homeowners in the district to complete their partial conversions. Staff and Edison inspectors have identified problems by walking the district – property owners have not called to identify their difficulties. Six were done by a firm that is no longer in business and, although the company initially began fixing the problems at two of these locations, no one called for inspections and both locations were left in disarray. A handyman performed work at three locations and left them half-finished. The remaining six homeowners have yet to complete the work necessary to meet City and Edison standards.

In the event that the City Engineer has to cause some or all of the remaining private work to be done, Staff is recommending that City Council dispense with the formal bidding process. Since time is of the essence, this would allow for the work to be accomplished with minimal delay as well as expense to the district. Therefore, the goal to have all wires and power poles removed by September can be realized.

Staff will develop a scope of work for each property as needed and ask interested contractors to submit quotations. It is anticipated that three (3) quotations will be received for each request. Staff anticipates having to negotiate a fair price for some work as well. Staff will keep Council abreast of activities through the monthly status report. In addition, upon completion of all the work the City Engineer will file a written report with the City Council.

 

Fiscal Impact:

Sufficient funds are available in the district to cover this proposed additional cost.
