CIVIL SERVICE BOARD - UNEXPIRED TERM ENDING JULY 15, 2003

 

Recommendation:

It is recommended that the City Council accept with regret the resignation of Ruth Brand from the Civil Service Board, effective December 31, 2000, and direct the City Clerk to advertise the Board vacancy with a newspaper publication and normal posting procedures, as has been standard practice in the past, inviting applications from persons interested in being appointed to fill the unexpired term ending July 15, 2003.

 

Background:

The City Clerk's office received the attached letter of resignation (effective December 31, 2000) from Civil Service Board member Ruth Brand, thereby creating an unscheduled vacancy. A special vacancy notice was posted December 28 in the Clerk's office and the Library, as required by State law, as well as in the City Hall outdoor display case.

Pursuant to Government Code Section 54974, appointment to fill the vacancy may not be made for at least 10 working days after the posting of the notice in the Clerk’s office (which falls after the January 9 meeting). That Code Section further states that Council "may, if it finds that an emergency exists, fill the unscheduled vacancy immediately. A person appointed to fill the vacancy shall serve only on an acting basis until the final appointment is made pursuant to this section." There is no emergency that requires filling the vacancy immediately.

If the Council directs the recommended advertising, a notice inviting applications will be published twice (January 18 and 25) in the Easy Reader, with a deadline of 6 p.m. Tuesday, March 6., for submitting applications. The matter would then be back before Council on the March 13 agenda for the scheduling of applicant interviews prior to the regular March 27 meeting, with appointment to be made during that regular meeting.

Ms. Brand has served on the Board since November 13, 1986, when she was appointed by the City Council to fill an unexpired term. A plaque of appreciation will be prepared for Ms. Brand in recognition of her 14 years of outstanding service to the City.
