MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL

of the City of Hermosa Beach, California, held on Tuesday, October 9, 2007, at the hour of 7:15 p.m.

ANNOUNCEMENTS

Councilmember Bobko (1) thanked everyone responsible for making the Centennial Dinner a smashing success, including Chris Miller, Kathy Bergstrom, Susan Blaco, Michael DiVirgilio, and Mayor Michael Keegan, noting that the event featured the best food he had ever had at a catered buffet; (2) reminded everyone about the Chamber of Commerce luncheon Friday, October 12, honoring Man of the Year Michael Flaherty and Woman of the Year Kelly Kovac-Reedy; and (3) encouraged everyone to attend or watch on television the next Upper Pier Avenue Committee meeting of October 29, noting that the group is picking up momentum and had recently taken a walking tour of El Segundo’s downtown, impressive for how beautiful the area had become, and he expressed hope for the same results from the efforts of the Upper Pier Avenue Committee.

Councilmember Reviczky agreed that the Centennial Dinner was a wonderful event and thanked Sienna Tucker, Dorothy Yost and especially Robin Maynard in the City Manager’s Office who kept track of the ticket sales and sold tickets at the door. He asked that the meeting be adjourned in memory of Eizo Etow, a Rotarian, long-time Hermosa resident and renowned artist who passed away the previous week, and expressed sympathy to his son.

Mayor Keegan encouraged everyone to look at the newest addition to Pier Plaza which was dedicated September 30 – a mural on the wall of the Cantina Real depicting Hermosa Beach history. He thanked everyone who made this mural possible, including private donors, those who raised funds by assisting with the handprint wall, Tony Grocton, Chris Miller and Rick Koenig.

PUBLIC PARTICIPATION:

  1. ORAL AND WRITTEN COMMUNICATIONS

    There were no written communications.

    Coming forward to address the City Council at this time were:

    Chris Miller - representing the 100 Acts of Beautification and the Centennial Dinner, thanked the Council for allowing the dinner to take place and said the people who worked on the event made it successful; said she was raised in Hermosa Beach and that her father went home after the dinner with a real sense of Hermosa as he remembered it; hoped it would give residents a new inspiration to continue the dream of this wonderful community for the next 100 years;

    Margaret Maldone - Hermosa Beach, spoke in opposition to the ordinance banning smoking on the City’s beach; said smoking on the sand was not a fire hazard; caused no air pollution and cigarette butts could be handled by enforcing the litter law; said it was not fair to take away a person’s rights and asked the Council to overturn the law;

    Jim Lissner - Hermosa Beach, said he attended the Upper Pier Avenue Committee’s tour of downtown El Segundo, was particularly impressed by the landscaping; encouraged residents to view survey results on the website www.vivahermosa.com noting that he had sent those results to the Councilmembers; noted upcoming candidate debates – 12:30 p.m. Wednesday, October 10, at the Clark Building, sponsored by the Woman’s Club, 11 a.m. Friday, October 19, at Sangria, sponsored by the Chamber of Commerce; and 7-9 p.m. Monday, October 22, in the Council Chambers sponsored by the Neighborhood Association – and hoped they would be video-streamed on the City’s website; and

    Sienna Tucker and Dorothy Yost - representing the Hermosa Woman’s Club, invited everyone to the Club’s annual pancake breakfast on Sunday, October 21, from 8 a.m. to noon, with tickets at $8 per person or $15 for two, which could be purchased at the door; said there would also be a raffle and a Chinese auction and a silent auction at the event.

  2. CONSENT CALENDAR:

    Action:To approve the consent calendar recommendations (a) through (h), with the exception of the following item, which was removed for discussion in item 4, but is shown in order for clarity: 2(g) Reviczky

    1. RECOMMENDATION TO APPROVE THE MINUTES OF THER REGULAR MEETING OF SEPTEMBER 11, 2007.

      Action: To approve, as presented, the minutes of the Regular Meeting of September 11, 2007.

    2. RECOMMENDATION TO RATIFY CHECK REGISTER NOS. 49436 THROUGH 49583 AND TO APPROVE CANCELLATION OF CHECK NOS. 48792 AND 48474 AS RECOMMENDED BY THE CITY TREASURER.

      Action: To ratify the check register as presented.

    3. RECOMMENDATION TO RECEIVE AND FILE TENTATIVE FUTURE AGENDA ITEMS.

      Action: To receive and file the Tentative Future Agenda Items.

    4. RECOMMENDATION TO RECEIVE AND FILE THE ACTION MINUTES OF THE UPPER PIER AVENUE COMMITTEE MEETING SEPTEMBER 12, 2007.

      Action: To receive and file the action minutes of the Upper Pier Avenue Committee meeting September 12, 2007.

    5. RECOMMENDATION TO RECEIVE AND FILE THE ACTION MINUTES OF THE PUBLIC WORKS COMMISSION MEETING OF SEPTEMBER 19, 2007.

      Action: To receive and file the action minutes of the Public Works Commission meeting of September 19, 2007.

    6. RECOMMENDATION TO ADOPT A RESOLUTION ESTABLISHING FINES FOR ADMINISTRATIVE CITATIONS. Memorandum from Community Development Director Ken Robertson dated October 1, 2007.

      Action: To approve the staff recommendation to adopt Resolution No. 07-6569, entitled “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HERMOSA BEACH, CALIFORNIA, PROVIDING FINES FOR ADMINISTRATIVE CITATIONS.”
      Motion Reviczky, second Mayor Keegan. The motion carried by a unanimous vote.

    7. RECOMMENDATION TO ACCEPT DONATIONS OF $1,200 FROM THE TASTE OF HERMOSA BOOTH FEES TO BE USED FOR CENTENNIAL CELEBRATION COSTS. Memorandum from Finance Director Viki Copeland dated October 1, 2007.

      This item was removed from the consent calendar by Mayor Pro Tempore Reviczky for separate discussion later in the meeting in order to acknowledge and thank the donors.

      Action: To accept the donation of $1,200 from The Taste of Hermosa booth fees to be used for Centennial Celebration costs.
      Motion Reviczky second Mayor Keegan. The motion carried by a unanimous vote.

    8. RECOMMENDATION TO AUTHORIZE STAFF TO ISSUE A CHANGE ORDER FOR PROJECT CIP 05-413 SEWER IMPROVEMENTS FOR EXTRA WORK ENCOUNTERED DURING THE CONSTRUCTION AND TO AUTHORIZE THE TRANSFER OF $52,993 FROM CIP 07-423 (301-8423-4201) TO CIP 05-413 (301-8413-4201). Memorandum from Public Works Director Richard Morgan dated October 2, 2007.

      Action: To approve the staff recommendation to:
      (1) Issue a Change Order for Project CIP 05-413 Sewer Improvements for extra work encountered during the construction; and
      (2) Authorize the transfer of $52,993 from CIP 07-423 (301-8423-4201) to CIP 05-413 (301-8413-4201).

  3. CONSENT ORDINANCES

    1. ORDINANCE NO. 07-1287 – “AN ORDINANCE OF THE CITY OF HERMOSA BEACH, CALIFORNIA, AMENDING SECTION 17.52.070 OF THE ZONING ORDINANCE PERTAINING TO REBUILDING OF DAMAGED NONCONFORMING STRUCTURES.” For adoption . Memorandum from City Clerk Elaine Doerfling dated October 3, 2007.

      Action: To waive full reading and adopt Ordinance No. 07-1287.

    1. Request by Mayor Pro Tem Reviczky to install “No Littering” signs on the Greenbelt with the amount of the fine included on the sign.

      Action: To refer the issue to the Public Works Commission for review and recommendation, with the suggestion for rustic looking wooden signs in cement blocks along the Greenbelt, and the possible placement of signage in other parts of town as well.
